How the checker decides
Producer status follows the transaction, not simply the brand name.
The PPWR identifies the producer through a set of routes covering domestic supply, cross-border direct sales, third-country sellers and certain unpacking situations.
The result above is therefore generated for one specific destination Member State and one specific transaction model.
Domestic first making available
Art. 3(1)(15)(a)–(b)An EU-established manufacturer, importer or distributor can be the producer where it first makes the relevant packaging or packaged product available in the same Member State.
Cross-border direct-to-end-user supply
Art. 3(1)(15)(c)–(d)An operator established in another Member State or in a third country can be the producer when it makes packaging or packaged products directly available for the first time to end users in the destination country.
Sale to an importer or reseller
Distribution chainWhere the recipient will further distribute the packaged product, the economic operator that first makes it available in the destination Member State may instead hold the producer role there.
Unpacking without being the end user
Art. 3(1)(15)(e)An EU-established operator that unpacks packaged products without being the end user can fall within the producer definition where another person is not already the producer under the preceding routes.

Commission Guidance 2026A branch or VAT registration without separate legal personality should not be treated in the same way as a separately incorporated EU legal entity when identifying the relevant PPWR operator.
