Can the same packaging EPR checklist be used for all 27 EU countries?

The operating workflow can be standardised, but the legal answer cannot. Registers, EPR systems, authorised-representative rules, reporting procedures, regulatory charges, deposit-return systems and evidence requirements must be verified separately for each destination Member State.

Does completing the EU Market Entry Checklist mean that my business is legally compliant?

No. The checklist organises and verifies the work that must be completed. Legal compliance depends on the actual EU and national rules and on completing the required registrations, EPR-system participation, representation, reporting, payments and evidence requirements for the relevant transaction and destination country.

Does every non-EU seller need an EPR authorised representative in every EU country?

No universal answer should be assumed. The result depends on which legal entity is the packaging EPR producer, where that producer is established, the transaction route, the destination Member State and the current EU and national representation rules. What does Verified Complete mean in the checklist?

Verified Complete means that the relevant action has actually been completed and the record contains appropriate supporting evidence, the controlling source or country rule and a completion or verification date where required. A draft, quotation, email or unchecked user statement is not automatically sufficient evidence.

What evidence should be retained for EU packaging EPR market entry?

Depending on the country and obligation, evidence may include the producer assessment, registration confirmation and number, public-register result, EPR-system or PRO agreement, authorised-representative mandate, packaging ledger, declaration acknowledgement, regulatory invoice, payment receipt, prefunding record, DRS or special-levy records and marketplace evidence.
